Terms of Service

1. Purpose

These general terms govern the use of the website perelweb.be and the services offered by Perel Web Studio SRL (hereinafter "Perel Web Studio", "we", "our").

By using our website and contacting us for our services, you unconditionally accept these general terms.

2. Services Offered

Perel Web Studio offers the following services:

4. Pricing and Payment

Our rates are customized for each project and communicated in our detailed quotes.

4.1 Payment Terms

• Prices are quoted in euros (EUR), including 21% Belgian VAT for Belgian clients
• A deposit is generally required to start the project (percentage defined in quote)
• Payments are made by bank transfer
• Balance is payable upon final project delivery

4.2 Late Payment

In case of late payment, interest may be applied in accordance with Belgian legal rates, along with a flat fee for collection costs.

5. Intellectual Property Rights

5.1 Client Work

Unless otherwise agreed in writing, intellectual property rights for custom creations are transferred to the client after full payment of the project. Perel Web Studio retains the right to present completed work in its portfolio and for marketing purposes, unless the client requests otherwise in writing.

5.2 Pre-existing Elements

Pre-existing elements (frameworks, open-source libraries, reusable components) remain the property of Perel Web Studio or their respective creators. The client receives a license to use these elements within their project.

6. Warranties and Maintenance

6.1 Conformity Warranty

We warrant that deliverables conform to specifications validated in the project brief. A 30-day period after delivery is allowed to report any non-conformity.

6.2 Bug Fixes

Bugs identified within 90 days following final delivery are fixed free of charge, provided no modifications have been made to the code by a third party.

6.3 Maintenance

Ongoing maintenance (updates, hosting, support) is not included in the initial price unless otherwise stated. Maintenance contracts can be subscribed separately.

7. Client Obligations

The client agrees to:

• Provide all elements necessary for project completion (content, images, access, etc.)
• Respond to validation requests within agreed timeframes
• Ensure they have rights to all content provided
• Respect agreed payment deadlines
• Not modify source code without our prior agreement during warranty period

8. Limitation of Liability

Perel Web Studio makes every effort to provide quality services. However, our liability is limited as follows:

• Our liability is limited to the total amount paid for the project concerned
• We are not responsible for indirect damages (loss of profit, data, business opportunities)
• We do not guarantee specific SEO or advertising results (Google rankings, conversion rates, etc.)
• We are not responsible for malfunctions caused by third-party services (hosting, plugins, external APIs)
• In case of force majeure, our obligations are suspended

9. Termination and Cancellation

9.1 By the Client

The client may cancel an ongoing project with written notice. Already paid amounts remain due for work completed. The balance corresponding to work performed until the cancellation date will be invoiced.

9.2 By Perel Web Studio

We reserve the right to terminate a contract in case of non-compliance with client obligations (particularly payment delays exceeding 30 days or failure to provide necessary elements after repeated reminders).

10. Confidentiality

Perel Web Studio commits to treat confidentially all information communicated by the client in the context of service provision. This obligation also applies to our development team located in Sri Lanka.

For our white label services, we commit to never revealing our involvement to our partner agencies' end clients.

11. Hosting and Domain Names

Unless otherwise stated in the quote:

• Web hosting is not included in our development services
• Purchase and renewal of domain names are the client's responsibility
• We can recommend suitable hosting solutions and assist with configuration
• For certain projects, we offer packages including hosting (detailed in quote)

12. Disputes and Applicable Law

12.1 Applicable Law

These general terms are governed by Belgian law.

12.2 Amicable Settlement

In case of dispute, we commit to seeking an amicable solution before any legal action. The parties will endeavor to resolve any disagreement through good faith negotiation.

12.3 Jurisdiction

Failing an amicable agreement, any dispute will be submitted to the exclusive jurisdiction of the courts of the Brussels judicial district (francophone).

13. Website Use

By using our site, you agree to:

• Not use the site for illegal or unauthorized purposes
• Not attempt to access non-public areas of the site
• Not copy, reproduce, or redistribute content without authorization
• Not disrupt site functionality (spam, viruses, hacking attempts)
• Respect intellectual property rights

14. Site Availability

We strive to ensure continuous availability of our website. However, we cannot guarantee 100% availability and reserve the right to temporarily suspend site access for maintenance, updates, or technical reasons, without liability on our part.

15. Modification of Terms

Perel Web Studio reserves the right to modify these general terms at any time. The applicable terms are those in force on the date of your order or use of the site. Any modifications will be published on this page with an update date.
